1. What Fochanka provides

Fochanka records impacts and vibrations and displays journeys, metrics and progress. Results are indicative and depend on the phone, its placement, the vehicle and the journey. Errors or missed events are possible. This is not an official inspection or a guarantee of road safety.

2. Responsible use

Prepare the measurement before setting off. Do not handle the phone while driving; obey traffic rules and signs. The absence of an alert does not rule out a hazard. Do not seek out potholes or manoeuvre to earn points.

3. Account and permissions

Use your own account and protect its access. You must have legal capacity to accept these terms or the authorisation required by law. You can deny or withdraw iOS permissions; features that need them will become unavailable.

4. Aliases and rankings

Do not use offensive, discriminatory or threatening aliases, impersonate others or include contact details. Reported aliases are reviewed and may be hidden or replaced with a generic alias, with notice of the change. You can choose another in Profile. Replacing an alias does not remove the account or its points. Do not manipulate measurements, scores or reports or submit unlawful content.

5. Journeys and community coverage

The detailed journey archive is private. Measurements also help produce aggregated road information. Published coverage must not identify participants or allow their individual journeys to be reconstructed. If you share an export, you choose its recipients.

6. Online archive and availability

The online archive is auxiliary, with limited capacity and no guarantee of uninterrupted availability or indefinite retention. Significant foreseeable changes and a planned shutdown will be announced with reasonable notice, allowing export of available data where technically and legally possible.

7. Software and contributions

You may use the app for its intended features. You may not exploit its code or content or circumvent security without authorisation, except where the law permits. You retain rights to your contributions and authorise their hosting and processing to provide the described features, without permitting the sale of personal data or publication of private journeys.

8. Privacy

Read the privacy policy in the app or at fochanka.com/privacy/. It explains the data used, its purposes and how to exercise your rights or delete your account.

9. Restricting access

We may proportionately restrict or suspend access for fraud, abuse, serious breaches, security risks or legal requirements. The reason and how to contact support will be provided where possible. You can stop using the app and delete your account without penalty.

10. Liability

Fochanka does not replace an inspection or the driver's attention. Liability is governed by applicable law. These terms do not exclude liability or limit rights where the law does not allow this.

11. Changes and applicable law

Significant changes will be communicated and require renewed acceptance where appropriate. They will not apply retroactively to your disadvantage. Spanish law applies, respecting mandatory protections in your country of residence and the courts competent under the law. Translations do not reduce your rights.
